Brexit: The UK Is Leaving the EU But Not Europe! What You Need to Know to Maintain European-Wide IP Protection

Understanding the IP landscape in Europe can be challenging for practitioners in the US who are used to a geographically large and unified national IP system. The complexity and duality of national IP systems in Europe with an encompassing EU IP system will now be made more complex after December 31, 2020, when the United Kingdom leaves the EU: the transition that has been given the infamous nickname Brexit.

In this presentation we will consider the impact of Brexit on the core IP rights of patents, trademarks, designs and copyright and provide practical advice on the impact on these rights and the steps that should be taken to secure continuity of protection in the EU and the UK.

A key takehome of this presentation will be an understanding of the relationship between the EU and the countries in Europe and how this relationship impacts on European IP rights.
